This website allows rooms and related services to be booked via the online booking platform elloha.com, hereinafter referred to as our booking platform.

Purpose

These terms and conditions govern all the steps necessary to make a booking and any related follow-up required between the contracting parties.

The customer acknowledges having read and accepted these terms and conditions of sale and the booking conditions which can be found on our booking platform, accessible from the website www.hotel-bellugues.com.

These terms and conditions of sale apply to all online bookings made via our booking platform, accessible from the website www.hotel-bellugues.com.

Booking

The customer chooses from the services offered on our booking platform. The customer acknowledges that they have familiarised themselves with the nature, intended use and booking methods of the services available on our booking platform and have requested and obtained the necessary and/or additional information to complete the booking in full knowledge of the facts.

The customer is solely responsible for deciding on their chosen services and for choosing services that are suitable for their needs, therefore we cannot be held liable in this respect.

The booking is deemed to be accepted by the customer at the end of the booking process.

The booking process

Bookings are made by the customer using the digital booking form available online on our booking platform. The booking is deemed to be confirmed as soon as the booking form has been received.

Prior to any booking, the customer undertakes to provide the information requested on the booking form or booking enquiry. The customer certifies that the information provided is valid and accurate.

As part of the booking procedure, after the customer has chosen the services that they want to book, bank card details must be provided in the event that a deposit or prepayment is required. The customer must read and accept the terms and conditions of sale and the booking conditions before completing the booking and, finally, the customer must confirm the booking.

Acknowledging receipt of the booking

Our booking platform acknowledges receipt of the customer’s booking immediately via email.

For online bookings, the acknowledgement of receipt email summarises the contract offer, the services booked, the price, the conditions that apply to the booking rate that have been accepted by the customer, the date on which the booking was made, the information relating to after-sales service, as well as the address of the Les Bellugues Hotel, to which the customer can send complaints.

Cancellation or modification by the customer

Cancellation conditions are as follow :

  • before 8 days before the date of your stay = no cancellation charge
  • between 8 days and 72 hours = 50% of the cost of the stay is due.
  • within 72 hours of the arrival date = 100% of the cost of the stay is due.


All requests for cancellation must be made by e-mail to our address: hello@hotel-bellugues.com, which will be confirmed as having been taken into account.

The customer is reminded, in accordance with Article L. 121-21-8 12° of the French Consumer Code, that the customer does not have the right of withdrawal provided for in Article L. 121-21 of the Consumer Code.

The booking terms specify the conditions for the cancellation and/or modification of the booking.

Bookings that have been paid for in advance cannot be modified and/or cancelled. The amounts paid in advance, i.e. the deposit, will not be reimbursed. Where this is the case, it is mentioned in the booking terms.

When booking terms allow, the booking may be cancelled directly with the Les Bellugues Hotel. The hotel’s telephone details are provided on the booking confirmation sent via email.

Any booking is non-transferable and may not, under any circumstances, be given to a third party, free of charge or for a fee. It is requested that customers schedule to arrive at the hotel before 19:00 and the customer is asked to notify reception if their arrival will be after 19:00.

In the event of an early departure, regardless of the reason, the booking must be paid for in full. Between 15 June and 15 September, any cancellation occurring less than 8 days before the arrival date will incur a charge amounting to 50% of the total cost of the stay. Before 15 June and after 15 September, this will apply if a booking is cancelled less than 48 hours before the arrival date. In the event of a no-show, you will be charged 100% for the service.

Use of the service

In accordance with current French regulations, the customer may be asked to complete a police form upon arrival. For this reason, the customer will be asked to show a form of identification in order to check whether or not they are required to fill-in the police form.

Any behaviour considered contrary to public policy or public decency will result in the establishment asking the customer to leave the hotel without any compensation and/or without any reimbursement if a payment has already been made.

The customer accepts and undertakes to abide by the Internal Rules and Regulations of the Les Bellugues Hotel.

If the customer breaches any of the Internal Rules and Regulations, the Les Bellugues Hotel will be obliged to ask the customer to leave the hotel without any compensation and/or without any reimbursement if a payment has already been made.

Liability

The photographs shown on the website of the Les Bellugues Hotel in addition to those on our booking platform are not contractual. Although every effort is made to ensure that the photographs, graphical representations and texts reproduced to depict the hotel give as accurate a picture as possible of the services offered, variations may occur from the time of booking to the day that the service is used.

The Les Bellugues Hotel cannot be held liable for any failure to perform or improper performance of the booked services caused by a force majeure, a third party or the customer, in particular issues related to a lack of internet access, the website being unavailable, external intrusion, computer viruses or an advance payment not being authorised by the cardholder’s bank.

Any booking or payment that is irregular, inoperative, incomplete or fraudulent for a reason attributable to the customer will result in the cancellation of the order at the customer’s expense, without prejudice to any civil or criminal action against the latter.

Complaints
Any complaints related to the failure to perform or improper performance of the booked services, under penalty of preclusion, must be reported to us in writing within eight days of the departure date from the Les Bellugues Hotel.
Rates

The rates for booking the services are indicated before and during the booking process. The rates confirmed to the customer are in Euros, including VAT, and are only valid for the period of time indicated on the Les Bellugues Hotel website and on the booking platform.

If, at the Les Bellugues Hotel, the balance is paid in a currency other than the currency which is confirmed on the booking, the exchange charges will be charged to the customer. All bookings, regardless of their origin, are payable in euros. Unless otherwise stated on the booking platform, additional services are not included in the price. Taxes (local taxes, tourist taxes, etc.) where applicable, shown on our Booking & Rates page, must be paid directly on site at the hotel reception. The price includes the VAT applicable on the day of booking and any change in the applicable rate of VAT will be automatically applied to the prices indicated on the billing date.

Any modification or introduction of new statutory or regulatory taxes imposed by the relevant authorities will be automatically applied to the prices indicated on the billing date.

Payment

Unless special terms or rates have been agreed, to guarantee the booking, the customer provides their bank card details, either a credit card or charge card (Visa, Mastercard, etc. depending on the options offered by the hotel’s booking platform), by indicating in the appropriate fields provided (via SSL secure encryption), the card number, with no spaces between the figures, the expiry date (the bank card used must be valid on the date that the service is used) and the card’s visual cryptogram. The bank card used to secure the booking must be presented at the hotel reception.

Payment is made at hotel reception during the stay, unless special terms or rates are agreed that require partial or total payment at the time of booking. This prepayment is considered a deposit.

In the event of a no-show (a booking that was not cancelled but where the customer is not present) where the booking was secured with a bank card, the Les Bellugues Hotel will charge the customer’s card, by way of compensation, the amount indicated in its terms and conditions of sale. Les Bellugues Hotel has chosen elloha.com/stripe.com to secure online payments by bank card. The validity of the customer’s payment card is verified by stripe.com.

There are several reasons why a card may be declined including it being a stolen or blocked card, it may have reached its limit, or there may have been an entry error, etc. In the event of a problem, the customer must contact their bank firstly, and then the Les Bellugues Hotel to confirm their booking and their payment method. In the event that a rate is subject to an online prepayment, the amount paid in advance, i.e. the deposit, is debited at the time of booking.

Privacy Policy

On each of the forms that capture personal data, an asterisk is used to inform the customer of what information is mandatory.

The data processed is intended for use by the Les Bellugues hotel, elloha.com, its entities, partners and service providers (and in particular online payment service providers).

The customer authorises the hotel Les Bellugues and elloha.com to share the customer’s personal data with third parties provided that the sharing of data is consistent with the Les Bellugues Hotel and elloha.com conducting their business in accordance with these terms and conditions and the Customer Data Protection Policy. When making online payments, it will be necessary for the payment service provider stripe.com to send the customer’s bank details to the Les Bellugues hotel’s bank for the performance of the booking contract.

The customer is informed that this data transfer may therefore be carried out in foreign countries that do not have adequate data protection under the Data Protection Act. However, the customer consents to this transfer, which is necessary for the booking to be performed.

Constellation SAS / stripe.com, in a professional capacity, have undertaken to implement all security and data protection measures for these data transfers vis-à-vis the Les Bellugues Hotel.

Proof of Agreement

Providing the required bank details, as well as the accepting these terms and conditions and the booking form or enquiry, constitutes an electronic signature that has, for the parties, the same value as a handwritten signature.

The computer records stored on the IT systems of the Les Bellugues hotel and elloha.com will be stored under reasonable security conditions and will be considered as proof of communication, orders and payments made between the parties. The customer is informed that their IP address is recorded at the time of booking.

Force Majeure

A Force majeure is any event outside of the parties control, that is both unforeseeable and insurmountable, which prevents either the customer or the Les Bellugues Hotel from fulfilling all or part of the obligations set out in the contract.

Cases of force majeure or fortuitous events include those typically retained by French case law and the French courts.

Neither party may be held liable by the other party in the event of a failure to fulfil its obligations resulting from a force majeure.

It is expressly agreed that, for the parties, a force majeure suspends the performance of the mutual obligations of the parties and each party shall bear the resulting costs.

Litigation
These Terms and Conditions of Sale are governed by French law, without impeding the mandatory protective provisions that may apply in the consumer’s country of residence.
Scope

These Terms and Conditions of Sale, the booking conditions accepted by the customer, and the booking form or enquiry define the entirety of the obligations of the parties.

No general or specific conditions communicated by the customer may be incorporated in these terms and conditions. The documents constituting the contractual agreement between the parties are, in decreasing order of priority, the booking form or enquiry (including the specific booking conditions) and these Terms and Conditions of Sale.

In the event of a contradiction between the booking form and the Terms and Conditions of Sale, the provisions appearing in the booking form shall be the only provisions applicable to the obligation in question.

These Terms and Conditions of online sales may be modified and/or supplemented by the Les Bellugues Hotel at any time. In this case, the new version of the Terms and Conditions of Sale will be published online by the Les Bellugues Hotel.

As soon as it is published online, the new version of the Terms and Conditions of Sales will automatically apply to all customers.
